On Tuesday, November 24, the Delaware County Court of Common Pleas dismissed the temporary stay order of the election results of the 165th Legislative District of Pennsylvania. After a review of testimony and exhibits entered into evidence, the Court found insufficient evidence of fraud or errors to justify a recount or recanvassing of ballots.

As a result, the court vacated the temporary stay it had ordered on Monday morning against certification of Jennifer O’Mara’s victory over Robert Smythe, Jr., for the General Assembly seat in the 165th district. The Board of Elections certified the result in that race upon resumption of its certification meeting on Tuesday afternoon following the removal of the stay by the court.
