As a self-represented litigant, you are required to follow the procedures pursuant to the Pennsylvania Rules of Civil Procedure, which are located in the Law Library on the 4th Floor of the Delaware County Courthouse. You must also follow the divorce rules located in the Delaware County Local Rules, Rule 1920.1 through 1920.90.
A party seeking a divorce will need to file a complaint (an original and two (2) copies) with the Office of Judicial Support. A party must prepare and file an Entry of Appearance form for self-representing party. A complaint must contain a reference to the section of the Divorce Code under which the divorce is to be granted. The filing party must serve the complaint pursuant to the Pennsylvania Rules of Civil Procedure. Once filed, the parties are required to follow the state and local rules of procedure. Once a divorce complaint is filed, the case is randomly assigned to a judge by the District Court Adminstrator's Office.
All petitions submitted after the filing of a divorce complaint must be filed in the Office of Judicial Support. A Petition for Special Relief will be forwarded by the District Court Administrator's Office to the assigned judge who will notify the litigants of a hearing date. A party seeking equitable distribution must refer to Delaware County Local Rule 1920.54.
