Mary J. Walk, Esquire took office on January 2, 2018 as the Register of Wills and Clerk of the Orphans' Court. An attorney licensed to practice in the Commonwealth of Pennsylvania for over 18 years, Ms. Walk brings both her legal experience and commitment to public service to the Register of Wills office.
The Register of Wills' principal duty is the probate of wills and the acceptance for filing of all documents necessary to complete the administration of a decedent's estate. If a person dies without a will (i.e., intestate), the Register, upon petition, will appoint an administrator of the estate. The Register is also the Commonwealth of Pennsylvania's authorized agent for the collection of inheritance tax.
The Register of Wills is a quasi-judicial position, meaning that if necessary, the Register can conduct a hearing to determine who should be appointed as executor or administrator of an estate. The parties have a right to appeal the Register's decision to the Orphans' Court Division of the Court of Common Pleas.
The Register also serves as the Clerk of the Orphans' Court. Therefore, our office serves as the filing office and custodian of records for matters involving adoptions, guardianships and estate litigation. The office also issues all marriage licenses for Delaware County.

There were 3,141 new Register of Wills files. Many these new files were probates although we do create file numbers for non-probate matters as well.
The Register of Wills serves as an agent of the Commonwealth of PA for the collection of state inheritance tax. In 2018, the office collected $68,224,391.26 in inheritance tax payments. This money is separate from the various fees we collect on behalf of the Commonwealth every time we open a probate or issue a marriage license. In addition, our office pays a portion of our fees each month to the Delaware County Treasurer’s Office.
Finally, after deciding to accept appointments for probate, the office scheduled 668 appointments from June through December, 2018.
The Office issued 2,656 marriage licenses;
There were 87 opened adoption cases;
The Office opened 834 “other” Orphans’ Court files. These “other” types of files consisted of estate litigation, incapacitated persons, trusts, minors, corporate fiduciary qualifications and marriage license issues (e.g. waiver requests).
EFFECTIVE DECEMBER 11, 2018: On December 11, 2018, the PA Supreme Court-mandated Guardianship Tracking System (“GTS”) went live in Delaware County. With GTS, court appointed guardians will be able to file guardianship reports 24/7 from anywhere they have internet access. The payment of filing fees will be accepted online with a credit or debit card.

Effective immediately For the convenience of our customers, we are now accepting Credit and Debit cards for Probate. There is a 3% convenience fee per transaction.
Effective immediately There are two free-standing computers in our back office to be used for the look-up of Probate and Marriage Records. We are in the process of scanning in probate document images from prior years but going forward document images (with the exception of Death Certificates) will be available for self-service printing. When you arrive in our office, you will receive easy instructions for logging on to these terminals to perform your search and print any available records at a cost. Records can still be ordered via telephone or through the mail.
Effective August 20, 2018 - We will no longer accept cash for any transaction in our office (Probate, Orphans’ Court, Marriage License). We will accept credit or debit cards, checks, money orders, but NO CASH.
